Images of the Statue of Liberty (Joensuu)
[edit]The following files are derivative works of the Statue of Liberty (Finnish: Vapaudenpatsas), a 1923 sculpture by Yrjö Liipola (1881–1971; Q11903032), located in Joensuu, Finland:
- File:City Hall park in Joensuu.jpg
- File:Joensuu Statue of Liberty.jpg
- File:Vapaudenpuisto.jpg – De minimis may apply
The original work (the sculpture) is still under copyright and thus not in public domain until 2042-01-01. Freedom of panorama is for buildings only in Finland. ––Apalsola t • c 17:56, 25 October 2020 (UTC)
- The Finnish copyright law allows including works of art in photographs when they are not the main subject. This goes farther than de minimis. I think at least Vapaudenpuisto.jpg is an image of the park, where the statue is included because it is a central element of the park, not as the real subject. I'd say the same is true for City Hall park in Joensuu.jpg. Joensuu Statue of Liberty.jpg is intended to show the statue, as can be seen from the filename, but even here the focus is on the surroundings rather than on the statue itself. I'd say there is no need to delete any of them, but I am not a lawyer. Is there any case law? –LPfi (talk) 16:01, 27 October 2020 (UTC)
- The provision is in Section 25 (446/1995) of the Copyright Act (404/1961, here amendments up to 608/2015):
- Use of works of arts that have been made public or transferred (607/2015)
- ...
- (2) When a copy of a work of art has, with the consent of the author, been sold or otherwise permanently transferred, the work of art may be incorporated into a photograph, a film, or a television programme if the reproduction is of a subordinate nature in the photograph, film or programme. - At least in File:Joensuu Statue of Liberty.jpg, the statue is clearly the main subject: it is in the centre of the photograph and the photograph is focused to it. ––Apalsola t • c 17:04, 1 July 2021 (UTC)
Deleted: in all photos the status is obviously in the center of the photo and is a main object. --rubin16 (talk) 08:38, 13 August 2021 (UTC)
